I-601 and I-601A serve different waiver processes. A provisional I-601A waiver addresses qualifying unlawful-presence inadmissibility only. It does not waive every immigration problem, and a prior removal may involve a separate permission-to-reapply issue.

Begin with the legal ground, not the form number

  • Identify the specific ground of inadmissibility and the facts that trigger it.
  • Determine whether a waiver exists for that ground and applicant category.
  • Identify the qualifying relative and legal standard required by that waiver.
  • Map any separate prior-removal permission issue and the proposed filing sequence before departure.

Relevant guidance: USCIS provisional unlawful presence waiver.

Identify the ground before selecting a form

Ask which statutory ground is involved and how it arises from the facts. Unlawful presence, misrepresentation, criminal history, and a prior removal are not interchangeable labels. Obtain the actual refusal notice or immigration record when available.

A waiver strategy should account for all identified grounds. Resolving one issue does not necessarily make the person admissible. Do not leave the United States on the assumption that a pending or approved waiver covers every possible obstacle.

Understand the provisional process

An eligible applicant may seek a provisional unlawful-presence waiver before departing for immigrant visa processing. Approval does not grant permanent residence, excuse other inadmissibility grounds, or guarantee visa issuance. Eligibility and the required hardship relationship must be established.

A prior deportation or removal can require analysis of Form I-212 and other restrictions. The timing and interaction of applications matter, so a list of form names is not a complete legal plan.

Prepare evidence tied to the legal requirement

Collect immigration notices, travel records, court dispositions, and earlier applications first. For hardship review, provide genuine medical, financial, caregiving, educational, and country-related records relevant to the qualifying relative and the applicable standard.

Explain ordinary expenses and unusual burdens accurately. A hardship declaration should show how the facts affect the relevant person rather than relying on dramatic but unsupported language.

Ask counsel to explain the proposed sequence, departure risks, and what remains unresolved after any waiver approval. If the record contains multiple grounds or uncertain facts, those issues should be addressed before committing to travel or a filing strategy.

Frequently asked questions

Does I-601A waive fraud or a criminal ground?

No. It is limited to the specified unlawful-presence ground.

Is I-212 the same as a waiver?

It is a permission-to-reapply process addressing particular prior-removal consequences. Whether it is needed requires separate analysis.
