For a delayed I-485, confirm the application category, visa availability where required, pending evidence requests, and any unresolved eligibility issue. Employment-based applicants should also review job changes and portability separately from a possible delay claim.
Separate a delay problem from an eligibility barrier
- Confirm the adjustment category and any required visa availability.
- Identify an unresolved petition, RFE, background issue, or interview step.
- Review employment changes and portability under the actual category.
- Track work and travel authorization independently of the pending I-485 or any lawsuit.
Relevant guidance: USCIS Supplement J and job portability.
Identify what remains outstanding
Gather the I-485 receipt, petition approval where applicable, biometrics and interview records, requests for evidence, responses, and agency inquiries. Check whether the case is ready for adjudication under the relevant category.
A filed application or completed interview does not necessarily mean a visa number is available or every eligibility issue is resolved. Ask counsel to identify the actual barrier before selecting an inquiry or litigation strategy.
Review employment changes before relying on portability
Some eligible employment-based applicants may use the same-or-similar job portability provisions after an I-485 has been pending for at least 180 days. Other requirements and exceptions matter, and Supplement J is not used in every category.
Provide the original and new job descriptions, relevant petition records, and the date of any employment change. Do not assume that the passage of 180 days alone makes every move safe. NIW and other self-petition situations need category-specific review.
Maintain a separate plan for work and travel
A pending I-485 does not by itself authorize employment. Review current work authorization and travel documents, expiration dates, and any maintenance-of-status concerns. A lawsuit does not automatically extend those documents.
If the record supports further delay analysis, prepare a clear chronology and evidence of harm. Counsel should evaluate the agency's duty and the controlling law, as well as the risk of an unfavorable decision. There is no guaranteed post-filing timetable.
Family-based and asylee applicants have their own eligibility rules. Use this article to organize the delay review, then consult the practice guide for the actual adjustment category.
Frequently asked questions
Can I change jobs just because I-485 has been pending 180 days?
Not automatically. The relevant category, petition, job similarity, and other portability requirements need review.
Does a pending I-485 itself authorize work?
No. Work authorization requires an applicable independent basis.
