Asylee adjustment requires review of the asylum grant, qualifying physical presence, continuing eligibility, and any admissibility issue. Under USCIS policy, the one-year physical-presence requirement is assessed at adjudication; filing timing should still be planned around the complete case.

Confirm that the underlying protection is an asylum grant

  • An asylum application receipt is not proof that asylum was granted.
  • Withholding of removal or Convention Against Torture protection alone is not an asylum grant for this adjustment route.
  • Identify whether the applicant is a principal or derivative asylee and review the relevant family history.
  • Check physical presence, continuing eligibility, admissibility, and current filing instructions separately.

Relevant guidance: USCIS asylee adjustment eligibility.

Start with the asylum grant and identity records

Gather the approval notice or final court grant, I-94 if available, passports, birth record, and translations. Identify whether asylum was granted as a principal or derivative and collect relevant family documents.

Do not use an asylum receipt as if it were proof of a grant. If the decision came from immigration court, obtain the actual order and records needed to establish its status.

Build the post grant history

List all travel after the grant and retain departure and return evidence. Time outside the United States can affect the physical-presence calculation. Travel to the country of feared harm can also raise substantive questions that deserve review before filing or further travel.

Disclose arrests, charges, convictions, and other changes in circumstances. Provide the actual records rather than assuming an old issue no longer matters because asylum was granted.

Prepare the application under current instructions

Collect prior immigration applications, relevant civil documents, medical-examination materials as required, and any evidence needed for a derivative's eligibility. Check current editions, required photographs, signatures, fees or exemptions, and submission requirements for the individual category.

This preparation list is not a substitute for the current I-485 instructions. A principal and each derivative need their own eligibility and document review. A change in marriage or family circumstances may require additional analysis.

Before signing, compare the proposed application with the asylum record and correct any genuine inconsistencies transparently. Keep a full copy and track later notices. If processing is delayed, organize the complete history before evaluating inquiries or any litigation option.

Frequently asked questions

Must I wait one year before any filing is possible?

USCIS policy assesses the one-year presence requirement at adjudication. Counsel should still evaluate filing timing and every other requirement.

Can I ignore travel after the asylum grant?

No. Provide a complete travel history for presence and substantive eligibility review.
