An EB-2 national interest waiver requires both eligibility for the underlying EB-2 classification and a separate showing supporting waiver of the job-offer and labor-certification requirements. The proposed endeavor and evidence of the applicant's ability to advance it are central.
Start with EB-2 eligibility before the waiver argument
- Identify the advanced-degree or exceptional-ability basis for the underlying classification.
- Define the proposed endeavor specifically enough to assess its merit and national importance.
- Explain why this applicant is well positioned to advance that endeavor.
- Address why waiving the job-offer and labor-certification requirements would be beneficial on balance.

Define the endeavor precisely
Explain what you propose to do in the United States, who may benefit, and how the work will be carried out. A broad profession such as engineering or public health is not a complete description of an individual endeavor.
Connect the proposal to reliable evidence. Depending on the field, that may include prior work, publications, adoption of a method, contracts, funding, patents, or documented demand. Describe outcomes accurately and distinguish completed achievements from future plans.
Address the separate legal questions
USCIS examines the endeavor's substantial merit and national importance, whether the person is well positioned to advance it, and whether granting the waiver would be beneficial on balance. A degree or an impressive resume alone does not answer all of those questions.
Prepare letters that explain concrete contributions and their significance. Avoid interchangeable praise from people who cannot describe your work. Independent evidence should support the claims made in the narrative.
Plan beyond petition approval
An approved immigrant petition does not itself issue a green card or authorize employment. Visa availability, adjustment or consular eligibility, and the person's present status require separate planning.
Discuss how the endeavor will continue if your employer, funding, or project changes. Identify any inconsistency between the proposed work and the actual plan. A strategy should remain grounded in what you intend and are able to do.
For an initial review, gather your CV, degrees, proposed endeavor description, representative achievements, and current immigration records. Ehsan Law can evaluate whether NIW merits further development and how it fits into the broader immigration plan.
Frequently asked questions
Does every advanced degree qualify for NIW?
No. EB-2 classification and the waiver requirements must each be established.
Does I-140 approval allow me to work immediately?
Not by itself. Work authorization and permanent residence require separate eligibility.
