An asylum referral to immigration court means the case must be evaluated in its new procedural setting. Obtain the referral papers, NTA, hearing information, and complete prior application, then identify the next court obligation.
A referral is a change of forum, not a complete case assessment
- Read the actual USCIS notice and charging papers to identify the procedural action.
- Confirm whether EOIR has received the case and what hearing notice applies.
- Review the entire existing application before making court submissions.
- Address court deadlines, work authorization, and any custody concerns separately.
Relevant guidance: Federal Register affirmative asylum referrals without interview.
Read the referral instead of assuming what happened
Determine what USCIS issued and whether a court case has been filed. A referral and a final removal order are different events. Preserve every page and any delivery information.
A July 28, 2026 interim final rule addresses certain affirmative-asylum referrals without a prior interview. Its scope and any later developments must be checked for the individual case. Do not assume that every referral follows an interview or that the absence of an interview alone resolves the case's validity.
Obtain the old application and identify updates
Request the complete I-589, declaration, supporting evidence, notices, and interview records if any. Review the material with counsel before preparing a court submission. Correct identification and translation problems openly.
Record new events since filing and gather evidence where available. Keep the original version so the history remains clear. A new lawyer needs to understand both what happened and what was previously presented to the government.
Prepare for the first court obligations
Confirm the hearing date, format, location, and address-change requirements. Discuss representation, pleadings, relief, and the filing schedule. Do not assume a long-pending USCIS case will follow the same timetable after referral.
Work authorization, custody risk, and protection from removal are separate questions. Ask counsel how the changed posture affects each issue rather than relying on the fact that an asylum application is pending.
Bring the newest notice to intake even if the rest of the file has not arrived. An urgent court date should be reviewed before a records request is complete.
