EOIR’s current public instructions state that an ordinary notice of appeal from an immigration judge’s decision generally must reach the BIA within 30 calendar days of an oral decision or the mailing of a written decision. Confirm the deadline for the actual proceeding immediately: 2026 rule changes and litigation make it important to check the operative rules rather than rely on a general summary. Mailing on the last day is not enough.

Keep three separate dates on your calendar

  • Decision date: identify the oral ruling or the issuance and delivery history of a written decision.
  • Notice deadline: confirm the deadline and method for filing the notice of appeal; do not substitute a later briefing date.
  • Brief deadline: once a schedule is issued, track it separately and retain submission confirmations.

Calculate the deadline from the right event

Do not automatically count from the day a family member opens the mail. Have counsel review how the decision was issued, the applicable calculation rules, and any holiday or weekend issue. Other immigration appeals use different forms and deadlines.

Confirm that the decision is appealable to the BIA and that appeal rights were preserved. An instruction appropriate for a merits decision may not fit a different type of immigration proceeding.

Prepare a complete filing

A notice of appeal must do more than say that the decision was unfair. Identify the challenged findings and legal conclusions with enough detail to explain the dispute. Follow current instructions for signatures, service, payment or a permitted fee-waiver request, and the required filing system.

Retain the submission confirmation and check for rejection notices. Paying a fee, mailing a package, or opening an electronic draft is not the same as completing an accepted filing. Keep a copy of everything submitted.

Plan the work after the notice

The notice of appeal and the appellate brief are separate tasks. Track the BIA's record and briefing notices and keep the address of record current. If a brief was promised, failing to submit it or explain the failure can create serious problems.

If the ordinary deadline has passed, seek immediate review of whether any exceptional remedy is supportable. Do not assume a late filing will be excused, and do not give up solely because someone informally said it is too late. Provide evidence explaining both the delay and the steps taken to act diligently.

Frequently asked questions

Does postmarking the appeal meet the deadline?

Ordinarily no. The BIA's receipt requirement controls.

Should I wait for the transcript?

Do not let a transcript request cause a missed notice deadline. Counsel can plan record review and briefing separately.
